MOPED RULES AND REGULATIONS

Motorized Bicycles commonly known as "Mopeds" are a popular mode of transportation for Juveniles in Michigan City, and becoming increasingly popular with the rising cost of gasoline. Moped operators must follow all established traffic rules and regulations governing the operation of motor vehicles on streets and highways.

Indiana Code (9-13-2-109) defines a motorized bicycle as: ...A two- or three-wheeled vehicle that is propelled by an internal combustion engine or battery powered motor. If powered by a an internal combustion engine it has the following:

  1. An engine rating not more that 2 horsepower, and a cylinder capacity not exceeding 50 CC.
  2. An Automatic Transmission.
  3. A maximum design speed of not more than 25 MPH on a flat surface.

Indiana Code 9-21-11-12 stipulates that a Moped may not be operated:

  1. By any person under the age of 15 years old.
  2. Any person who does not possess an identification card, permit, or driver's license obtained from the Bureau of Motor Vehicles.
  3. On sidewalks or Interstate Highways.
  4. At a speed greater than 25 Mph.

Indiana Code 9-21-11-13 stipulates that a person under the age of 18 who operates a Moped on the street or highway shall:

  1. Wear protective headgear meeting minimum standards established by the Department of Transportation.
  2. Wear protective glasses, goggles, or a transportation face shield.

The Moped may not be ridden by more than 1 person unless specifically manufactured or designed to carry additional passengers.

Parents should also be aware of Indiana Code 9-21-11-1:
The parent of a child and the guardian of a protected person may not authorize or knowingly permit the child or protected person to violate the provisions for operation.

Persons in violation of these provisions (including parents and guardians) may be ticketed for a class C infraction. The Moped may also be subject to impound resulting in the additional cost of towing and storage fees.

Chief Simmons reminds parents and guardians that operation of Mopeds on the streets and highways in Michigan City can be very dangerous. He encourages parents and guardians to ensure that their children possess the proper safety equipment and receive proper training. The Michigan City Police Department will vigorously enforce these regulations to ensure the safety of all motorists.
